{"id":7719,"date":"2026-06-11T00:00:00","date_gmt":"2026-06-11T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/reparcelacion-urbanistica\/"},"modified":"2026-06-11T00:00:00","modified_gmt":"2026-06-11T00:00:00","slug":"reparcelacion-urbanistica","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/reparcelacion-urbanistica\/","title":{"rendered":"Reparcelaci\u00f3n urban\u00edstica"},"content":{"rendered":"<p>Se discut\u00eda, en un conflicto bastante concreto, pero f\u00e1cil de entender, si un <b>expediente de liquidaci\u00f3n definitiva<\/b> dentro de una reparcelaci\u00f3n forzosa (es decir, el reparto y ajuste de terrenos y gastos en una actuaci\u00f3n urban\u00edstica) hab\u00eda \u201ccaducado\u201d por tardar demasiado en resolverse. En este caso, la <b>Administraci\u00f3n auton\u00f3mica<\/b> aprob\u00f3 la cuenta de liquidaci\u00f3n definitiva de una reparcelaci\u00f3n vinculada a la ejecuci\u00f3n de un sector del plan general del municipio. El problema vino porque <b>pas\u00f3 m\u00e1s de 3 meses<\/b> entre que se inici\u00f3 el expediente y se dict\u00f3 la resoluci\u00f3n, y adem\u00e1s hubo una demora larga en notificarla. Por eso, las personas afectadas impugnaron la actuaci\u00f3n diciendo, en esencia: \u201cesto ha caducado, as\u00ed que no vale, y devu\u00e9lvanos lo pagado\u201d.<\/p>\n<p>El Tribunal Superior de Justicia (TSJ) les dio la raz\u00f3n. Su idea fue que como es un <b>procedimiento iniciado de oficio<\/b> por la Administraci\u00f3n, se aplica el plazo general de 3 meses para resolver; si se supera, procede la caducidad del expediente y, en consecuencia, la devoluci\u00f3n de las cuotas ingresadas (citando la L 39\/2015 art. 23.1 y 25.2).<\/p>\n<p>La Administraci\u00f3n auton\u00f3mica recurri\u00f3 al Tribunal Supremo (TS) y defendi\u00f3 lo contrario, que esto no es un \u201cprocedimiento administrativo com\u00fan\u201d independiente, sino una actuaci\u00f3n integrada dentro del <b>proceso reparcelatorio<\/b>, y que por tanto manda el <b>plazo espec\u00edfico urban\u00edstico de 5 a\u00f1os<\/b> desde la aprobaci\u00f3n de la reparcelaci\u00f3n (RGU art. 128 y 129).<\/p>\n<p>El TS estima el recurso argumentando que <b>no se aplica la caducidad<\/b> del procedimiento general, porque la liquidaci\u00f3n definitiva forma parte del proceso reparcelatorio y no es un procedimiento aut\u00f3nomo. Adem\u00e1s, matiza algo importante, como es, incluso si se incumple ese plazo de 5 a\u00f1os, eso ser\u00eda una <b>irregularidad no invalidante<\/b>, o sea, no anula autom\u00e1ticamente el acto.
