{"id":7563,"date":"2026-05-04T00:00:00","date_gmt":"2026-05-04T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/financiacion-inmobiliaria\/"},"modified":"2026-05-04T00:00:00","modified_gmt":"2026-05-04T00:00:00","slug":"financiacion-inmobiliaria","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/financiacion-inmobiliaria\/","title":{"rendered":"Financiaci\u00f3n inmobiliaria"},"content":{"rendered":"<p>El caso trata de un <b>pr\u00e9stamo hipotecario<\/b> en el que se aplicaba una\u00a0<b>cl\u00e1usula suelo<\/b>\u00a0(un inter\u00e9s m\u00ednimo del 3%) y un \u201ctecho\u201d (15%). Dos clientes <b>demandaron<\/b> al banco pidiendo, entre otras cosas, que <b>se declarara\u00a0nula<\/b>\u00a0esa cl\u00e1usula, que se eliminara del contrato y que se les <b>devolviera todo lo pagado<\/b> de m\u00e1s por su aplicaci\u00f3n desde la primera cuota hasta su eliminaci\u00f3n, adem\u00e1s de rehacer el cuadro de amortizaci\u00f3n y a\u00f1adir intereses.<\/p>\n<p>En <b>primera instancia<\/b>, el juzgado entendi\u00f3 que, antes incluso de presentarse la demanda, las partes hab\u00edan <b>firmado una\u00a0novaci\u00f3n<\/b>\u00a0por la que\u00a0se suprim\u00eda\u00a0la cl\u00e1usula suelo. Por eso, consider\u00f3 que ya <b>no ten\u00eda sentido \u201ccondenar\u201d<\/b> al banco a quitar una cl\u00e1usula que, en la pr\u00e1ctica, ya no estaba en el contrato. Aun as\u00ed, el juzgado s\u00ed conden\u00f3 al banco a\u00a0<b>devolver las cantidades<\/b> cobradas en exceso\u00a0desde la firma del pr\u00e9stamo hasta la fecha en que el suelo se elimin\u00f3 por esa novaci\u00f3n, con el inter\u00e9s legal correspondiente (y, desde la sentencia, los intereses procesales).<\/p>\n<p>El banco recurri\u00f3, pero la Audiencia Provincial <b>confirm\u00f3 la sentencia<\/b>. Despu\u00e9s la entidad bancaria lleg\u00f3 al Tribunal Supremo (TS) alegando b\u00e1sicamente que\u00a0<b>no se pod\u00eda obligar a devolver dinero<\/b>\u00a0si en la sentencia\u00a0no se hab\u00eda declarado expresamente nula\u00a0la cl\u00e1usula suelo, y que adem\u00e1s no se hab\u00eda hecho correctamente el <b>an\u00e1lisis de transparencia<\/b>.<\/p>\n<p>El TS desestima el recurso. Explica que, aunque en el fallo no se hiciera un <b>pronunciamiento formal de nulidad<\/b> (por entender los tribunales que \u201cno hab\u00eda objeto\u201d al estar ya eliminada),\u00a0en la fundamentaci\u00f3n se daba por supuesto que la <b>cl\u00e1usula era abusiva por falta de transparencia<\/b>, y que por eso la devoluci\u00f3n era l\u00f3gica y evidente. Adem\u00e1s, recuerda que el banco tampoco explic\u00f3 qu\u00e9 <b>informaci\u00f3n concreta<\/b> dio a los clientes para que entendieran de verdad el impacto econ\u00f3mico y jur\u00eddico del suelo.
