Por su lado, el nuevo inquilino se subroga en el contrato y asume todos los derechos y obligaciones que ten\u00eda el anterior arrendatario.<\/p>\n<p>En cambio, existe\u00a0un <em>arrendamiento de industria<\/em> cuando se dan las siguientes circunstancias:<\/p>\n<ul>\n<li>El arrendatario conserva la posesi\u00f3n del local, de modo que se mantiene como titular del contrato.<\/li>\n<li>El tercero se limita a explotar el negocio, es decir, lo alquila por un tiempo determinado a cambio del pago de una renta.<\/li>\n<\/ul>\n<p>Pues bien, debe tenerse en cuenta que la figura del arrendamiento de industria no puede utilizarse para ocultar un verdadero traspaso (es decir, una cesi\u00f3n del contrato de arrendamiento). Esto es importante porque, si en realidad ha existido un traspaso, debe cumplirse con la obligaci\u00f3n legal de notific\u00e1rselo al arrendador, que tiene derecho a incrementar la renta o incluso \u2014si as\u00ed se pact\u00f3 en el contrato de arrendamiento\u2014\u00a0a obtener un porcentaje del traspaso.<\/p>\n<p>Por tanto, en el caso de que usted explote un negocio en un local arrendado y quiera que un tercero contin\u00fae con su actividad, no olvide realizar la notificaci\u00f3n fehaciente (burofax) al arrendador en el plazo de un mes desde que tuvo lugar el traspaso o subarriendo.
