{"id":7503,"date":"2026-04-16T00:00:00","date_gmt":"2026-04-16T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/clausulas-abusivas\/"},"modified":"2026-04-16T00:00:00","modified_gmt":"2026-04-16T00:00:00","slug":"clausulas-abusivas","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/clausulas-abusivas\/","title":{"rendered":"Cl\u00e1usulas abusivas"},"content":{"rendered":"<p>El Tribunal Supremo (TS) ha dado la raz\u00f3n a unos consumidores que ped\u00edan que el banco les devolviera los <b>gastos de su hipoteca<\/b> que hab\u00edan pagado por culpa de una cl\u00e1usula que les obligaba a asumir todos los costes del contrato. En su d\u00eda, estos prestatarios firmaron un <b>pr\u00e9stamo hipotecario<\/b> con una condici\u00f3n que <b>cargaba en ellos todos los gastos<\/b>, y por eso acudieron a los tribunales pidiendo dos cosas, que se declarara <b>nula<\/b> esa cl\u00e1usula (por abusiva) y que el banco les <b>reintegrara<\/b> lo que hab\u00edan abonado, adem\u00e1s de los intereses.<\/p>\n<p>En primera instancia, el juez <b>declar\u00f3 nula la cl\u00e1usula<\/b> y conden\u00f3 al banco a devolver los gastos con intereses. El banco recurri\u00f3, pero con un matiz importante ya no discut\u00eda que la cl\u00e1usula fuera abusiva. Lo que intentaba era evitar pagar alegando que la <b>reclamaci\u00f3n de devoluci\u00f3n<\/b> estaba <b>prescrita<\/b> (es decir, que hab\u00eda pasado el plazo para reclamar).<\/p>\n<p>La entidad sosten\u00eda que el <b>plazo para reclamar<\/b> deb\u00eda empezar a contar desde que fue firme una <b>sentencia colectiva anterior<\/b> que hab\u00eda declarado la nulidad de esa misma cl\u00e1usula con efecto \u201cultra partes\u201d (o sea, m\u00e1s all\u00e1 de las personas que participaron en ese juicio). Seg\u00fan el banco, como esa abusividad ya <b>era \u201cnotoria\u201d<\/b> desde entonces, el tiempo para reclamar habr\u00eda empezado antes.<\/p>\n<p>Pero el TS <b>no acepta<\/b> ese planteamiento ya que, aunque exista una sentencia colectiva que declare la <b>nulidad con efecto general<\/b>, eso no significa autom\u00e1ticamente que empiece a correr el plazo para que cada persona reclame la devoluci\u00f3n del dinero. La <b>restituci\u00f3n<\/b> es una <b>acci\u00f3n individual<\/b> y lo decisivo es que el consumidor tenga un <b>conocimiento efectivo y concreto<\/b> de que su cl\u00e1usula es abusiva.
