{"id":7412,"date":"2026-03-20T00:00:00","date_gmt":"2026-03-20T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/vivienda-protegida\/"},"modified":"2026-03-20T00:00:00","modified_gmt":"2026-03-20T00:00:00","slug":"vivienda-protegida","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/vivienda-protegida\/","title":{"rendered":"Vivienda protegida"},"content":{"rendered":"<p>El Tribunal Supremo (TS) ha analizado un caso sobre una modificaci\u00f3n puntual de un <b>plan general metropolitano<\/b> que pretend\u00eda obtener <b>vivienda de protecci\u00f3n p\u00fablica<\/b> (VPP) en <b>suelo urbano consolidado<\/b>. La discusi\u00f3n se centra en si el planeamiento urban\u00edstico puede imponer <b>reservas de \u201ctecho\u201d<\/b> (edificabilidad) para VPP en este tipo de suelo cuando se hacen actuaciones edificatorias (por ejemplo, obras de edificaci\u00f3n), y, si eso <b>reduce la rentabilidad<\/b> del propietario, si debe pagarse una <b>indemnizaci\u00f3n<\/b> cuando esa carga no puede \u201crepartirse\u201d de forma equitativa entre propietarios.<\/p>\n<p>La persona <b>recurrente<\/b> defend\u00eda, como idea principal, que esas <b>reservas para VPP<\/b> no pueden exigirse en suelo urbano consolidado porque \u2014seg\u00fan su tesis\u2014 la obligaci\u00f3n estar\u00eda prevista solo para <b>actuaciones de urbanizaci\u00f3n<\/b>, no para actuaciones edificatorias. Y, de forma subsidiaria, dec\u00eda, si aun as\u00ed se admite la reserva, entonces supone una <b>restricci\u00f3n del uso o de la edificabilidad<\/b> que, si no puede distribuirse equitativamente, deber\u00eda compensarse econ\u00f3micamente. El Tribunal Superior de Justicia ya hab\u00eda rechazado estos argumentos.<\/p>\n<p>El TS confirma esa decisi\u00f3n. Explica que la <b>normativa auton\u00f3mica<\/b> ampli\u00f3 la reserva de VPP y <b>permite tambi\u00e9n aplicarla<\/b> en actuaciones edificatorias en <b>suelo urbano consolidado<\/b>, y recuerda que esta posibilidad fue avalada al reconocerse un <b>criterio favorable<\/b> a situar VPP en suelo ya urbanizado y en edificaciones nuevas o existentes. Adem\u00e1s, subraya que el <b>derecho de propiedad inmobiliaria<\/b> no es \u201cabsoluto\u201d, sino que est\u00e1 <b>condicionado<\/b> por lo que marque la ordenaci\u00f3n urban\u00edstica, no existe un \u201c<b>derecho a vetar<\/b>\u201d que se destinen viviendas a VPP si la norma lo permite.<\/p>\n<p>Sobre la <b>indemnizaci\u00f3n<\/b>, el TS indica que, para reclamarla, la <b>limitaci\u00f3n urban\u00edstica<\/b> debe ser singular, exceder deberes legales, no poder repartirse equitativamente y, adem\u00e1s, el propietario debe haber incorporado realmente el <b>derecho afectado a su patrimonio<\/b> (no basta una expectativa).
