{"id":7304,"date":"2026-02-18T00:00:00","date_gmt":"2026-02-18T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/proteccion-de-los-arrendatarios\/"},"modified":"2026-02-18T00:00:00","modified_gmt":"2026-02-18T00:00:00","slug":"proteccion-de-los-arrendatarios","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/proteccion-de-los-arrendatarios\/","title":{"rendered":"Protecci\u00f3n de los arrendatarios"},"content":{"rendered":"<p>El Tribunal Supremo (TS) ha rechazado la reclamaci\u00f3n de un \u201c<b>gran tenedor<\/b>\u201d que ped\u00eda que el Estado le <b>indemnizara<\/b> por los perjuicios que, seg\u00fan dec\u00eda, le caus\u00f3 el <b>tope legal<\/b> a las subidas del alquiler durante 2022.<\/p>\n<p>El conflicto nace con el\u00a0RDL 6\/2022, que se aplicaba inicialmente entre el\u00a031-3-2022 y el 30-6-2022, y que <b>despu\u00e9s se prorrog\u00f3<\/b> hasta el\u00a031-12-2022\u00a0mediante el\u00a0RDL 11\/2022\u00a0y el\u00a0RDL 20\/2022. En ese periodo, la norma <b>fij\u00f3 un l\u00edmite<\/b> a la actualizaci\u00f3n de las <b>rentas de alquiler<\/b> de vivienda, siendo que, para los\u00a0grandes tenedores, la subida\u00a0<b>no pod\u00eda superar<\/b>\u00a0la variaci\u00f3n anual del\u00a0\u00cdndice de Garant\u00eda de Competitividad (IGC), <b>hubiera o no acuerdo<\/b> entre arrendador e inquilino. Si el <b>arrendador<\/b>\u00a0no\u00a0era gran tenedor, primero contaba lo que hubieran pactado las partes y, si no hab\u00eda pacto, se aplicaba igualmente el IGC.<\/p>\n<p>El demandante alegaba que esto <b>le perjudic\u00f3<\/b> porque en sus contratos se hab\u00eda pactado actualizar con el\u00a0IPC, y el IGC, seg\u00fan sostiene, no puede pasar del\u00a02% (L 2\/2015). Por eso defend\u00eda que la <b>medida era \u201cexpropiatoria\u201d<\/b> y que proced\u00eda indemnizaci\u00f3n por <b>responsabilidad patrimonial del Estado<\/b> (LRJSP art.32.3 y 4).<\/p>\n<p>El TS no lo acepta ya que sostiene que <b>no hay expropiaci\u00f3n<\/b>, sino una\u00a0<b>delimitaci\u00f3n temporal<\/b>\u00a0de facultades del propietario en arrendamientos de vivienda, <b>compatible con la\u00a0funci\u00f3n social<\/b>\u00a0de la propiedad (Const art.33.2).
