{"id":7059,"date":"2025-12-04T00:00:00","date_gmt":"2025-12-04T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/hipoteca-inmobiliaria\/"},"modified":"2025-12-04T00:00:00","modified_gmt":"2025-12-04T00:00:00","slug":"hipoteca-inmobiliaria","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/hipoteca-inmobiliaria\/","title":{"rendered":"Hipoteca inmobiliaria"},"content":{"rendered":"<p>El Tribunal Supremo (TS) ha resuelto un caso en el que varios consumidores ped\u00edan anular la <b>cl\u00e1usula de su hipoteca<\/b> que fijaba el inter\u00e9s a pagar en funci\u00f3n del famoso <b>\u00edndice IRPH<\/b>, muy utilizado por bancos espa\u00f1oles como <b>referencia en pr\u00e9stamos hipotecarios<\/b>. Los clientes alegaban que el banco <b>no les hab\u00eda informado<\/b> correctamente de c\u00f3mo funcionaba este \u00edndice ni de sus <b>consecuencias<\/b> econ\u00f3micas, y reclamaban que se les aplicase el <b>Eur\u00edbor<\/b> (otro \u00edndice generalmente m\u00e1s bajo) o que, al menos, devolvieran el dinero pagado de m\u00e1s.<\/p>\n<p>El caso hab\u00eda sido desestimado tanto por el juzgado como por la Audiencia Provincial. Estas sentencias reconoc\u00edan que el banco <b>no hab\u00eda explicado toda la informaci\u00f3n<\/b> previa al contrato como deber\u00eda, pero consideraban que, a\u00fan con esa <b>falta de transparencia<\/b>, la cl\u00e1usula no era necesariamente nula ni abusiva.<\/p>\n<p>El TS da la raz\u00f3n al banco y explica que el hecho de que una <b>cl\u00e1usula no sea clara del todo<\/b> (lo que llaman \u201cfalta de transparencia\u201d) <b>no implica<\/b> que haya que <b>anularla autom\u00e1ticamente<\/b>. Para eso, hace falta adem\u00e1s que se demuestre que hay <b>mala fe<\/b> por parte del banco o que se ha producido un <b>desequilibrio<\/b> muy evidente, es decir, que el cliente sale claramente <b>perjudicado<\/b> en comparaci\u00f3n con lo habitual en el mercado.<\/p>\n<p>En este caso no se ha probado que el banco actuase con mala fe ya que el IRPH es un <b>\u00edndice oficial, p\u00fablico<\/b> <b>y controlado<\/b> por las autoridades, y la TAE del pr\u00e9stamo era parecida a la de otros productos similares. Adem\u00e1s, el <b>diferencial<\/b> a\u00f1adido era bajo. El TS tambi\u00e9n aclara que el banco <b>no estaba obligado<\/b> a prever ni explicar c\u00f3mo iba a evolucionar el <b>IRPH en el futuro<\/b>, ni se puede comparar la situaci\u00f3n \u00fanicamente con el Eur\u00edbor para decidir si es abusivo.
