{"id":7047,"date":"2025-12-02T00:00:00","date_gmt":"2025-12-02T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/carencia-por-reformas\/"},"modified":"2025-12-02T00:00:00","modified_gmt":"2025-12-02T00:00:00","slug":"carencia-por-reformas","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/carencia-por-reformas\/","title":{"rendered":"Carencia por reformas"},"content":{"rendered":"<p>En los contratos de arrendamiento de locales o naves industriales es habitual que el inquilino ejecute algunas obras de adaptaci\u00f3n del local a sus necesidades.\u00a0Pero, si las obras son de una cierta entidad, suele acordarse que al final del contrato quedar\u00e1n en beneficio del local.<\/p>\n<p>Tambi\u00e9n es habitual pactar que, durante unos meses, el inquilino no pagar\u00e1 la renta (precisamente porque va a costear unas obras que despu\u00e9s acabar\u00e1n beneficiando al local). En estos casos:<\/p>\n<ul>\n<li>Existe una relaci\u00f3n directa entre la renuncia del arrendador a cobrar un determinado n\u00famero de mensualidades y la obligaci\u00f3n del arrendatario de ejecutar las obras pactadas.<\/li>\n<li>Por tanto, en caso de incumplimiento, el propietario podr\u00e1 optar entre\u00a0que se le pague la renta no cobrada o exigir la ejecuci\u00f3n de las obras en los t\u00e9rminos pactados,\u00a0sin perjuicio, en ambos casos, de\u00a0la indemnizaci\u00f3n que le corresponda por los da\u00f1os que pueda acreditar.<\/li>\n<\/ul>\n<p>A estos efectos, en el contrato de arrendamiento se deber\u00e1 indicar, como m\u00ednimo, el plazo de ejecuci\u00f3n de las obras, las licencias necesarias, el presupuesto de la reforma, la memoria de calidades y los planos del resultado final.\u00a0<\/p>\n<p>Al finalizar el contrato, el arrendatario no podr\u00e1 pedir una compensaci\u00f3n adicional por el coste de las obras realizadas, quedando \u00e9stas en beneficio de la propiedad.<\/p>\n<p>En todo caso, debe tener en cuenta que:<\/p>\n<ul>\n<li>Si el inquilino no ejecuta las obras dentro del plazo de carencia, el propietario podr\u00e1 optar entre exigir su ejecuci\u00f3n, seg\u00fan lo pactado, o exigir el pago \u00edntegro de las rentas dejadas de cobrar.
