Es decir, puede mantener los salarios \u201ccongelados\u201d de un a\u00f1o para otro. En concreto:<\/p>\n<ul>\n<li>Puede compensar dicho incremento reduciendo en la misma cuant\u00eda el exceso que sus trabajadores ya vienen cobrando.<\/li>\n<li>Esta medida se conoce como \u201ccompensaci\u00f3n y absorci\u00f3n\u201d de salarios. Eso s\u00ed: para que la compensaci\u00f3n y absorci\u00f3n sea v\u00e1lida, debe operar sobre conceptos homog\u00e9neos (de la misma naturaleza o raz\u00f3n de ser).<\/li>\n<li>Hay convenios que incluyen limitaciones a esa compensaci\u00f3n y absorci\u00f3n (por ejemplo, que durante unos determinados a\u00f1os \u00e9sta no sea posible).<\/li>\n<\/ul>\n<p>Si, pese a lo anterior, una empresa ha subido cada a\u00f1o los salarios seg\u00fan los aumentos publicados, sin aplicar la compensaci\u00f3n o absorci\u00f3n a los trabajadores que cobran por encima de convenio, puede aplicarla a partir de ahora. Su forma de actuar no se habr\u00e1 convertido en una condici\u00f3n m\u00e1s beneficiosa para su plantilla:<\/p>\n<ul>\n<li>Para que esta situaci\u00f3n se convirtiera en condici\u00f3n m\u00e1s beneficiosa deber\u00eda haber existido una manifestaci\u00f3n clara por parte de la empresa de que renunciaba a la compensaci\u00f3n o absorci\u00f3n o de que mantendr\u00eda intactos los complementos pactados.<\/li>\n<li>La compensaci\u00f3n y absorci\u00f3n es un derecho previsto en la ley: aunque una empresa no lo ejerza un a\u00f1o (o varios), podr\u00e1 ejercerlo en los siguientes.<\/li>\n<li>La empresa no est\u00e1 obligada a justificar causas objetivas (por ejemplo, econ\u00f3micas o productivas) para compensar la subida a partir de un determinado a\u00f1o.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p> Nuestros profesionales le informar\u00e1n sobre cualquier duda que tenga respecto a la compensaci\u00f3n y absorci\u00f3n de salarios.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Si una empresa nunca ha compensado el incremento salarial de los empleados que cobran por encima de convenio, &iquest;puede &ldquo;congelar&rdquo; este a&ntilde;o su salario?
