En este caso, una persona demand\u00f3 a su banco porque ten\u00eda una cl\u00e1usula suelo en su <b>pr\u00e9stamo hipotecario<\/b>, que limitaba la bajada de los intereses, aunque el Eur\u00edbor estuviera muy bajo. El juzgado le dio la raz\u00f3n, anul\u00f3 la cl\u00e1usula y oblig\u00f3 al banco a <b>devolverle el dinero<\/b> cobrado de m\u00e1s.<\/p>\n<p>El banco, sin embargo, recurri\u00f3 alegando que ya hab\u00eda firmado con la clienta un <b>acuerdo de novaci\u00f3n<\/b>. En ese acuerdo, se eliminaba la cl\u00e1usula suelo, se fijaba un inter\u00e9s fijo durante cinco a\u00f1os y, adem\u00e1s, la clienta <b>renunciaba a reclamar<\/b> nada m\u00e1s sobre ese tema en el futuro. La Audiencia Provincial no acept\u00f3 los argumentos del banco y confirm\u00f3 la sentencia inicial.<\/p>\n<p>El caso lleg\u00f3 al TS, que ha dejado claro que el acuerdo de novaci\u00f3n es v\u00e1lido si cumple con los <b>requisitos de transparencia<\/b> y realmente elimina la cl\u00e1usula suelo. Sin embargo, tambi\u00e9n dice que la parte del acuerdo donde el cliente renuncia a reclamar en el futuro no es v\u00e1lida, porque va m\u00e1s all\u00e1 de lo que se discut\u00eda y <b>perjudica los derechos del consumidor<\/b>.
