Si una empresa contrata a un empleado con el que ha pactado un salario superior al del convenio, \u00bfc\u00f3mo debe confeccionar su n\u00f3mina? \u00bfEn qu\u00e9 concepto deber\u00e1 incluir ese exceso?<\/p>\n<p>Si no hay una raz\u00f3n espec\u00edfica por la que la empresa retribuye a su empleado por encima del salario de convenio (no va a trabajar a turnos, el puesto no es peligroso, no le va a pagar comisiones, no le va a requerir una mayor disponibilidad horaria&#8230;), puede abonar el exceso bajo el concepto <em>mejora voluntaria absorbible<\/em>. A estos efectos:<\/p>\n<ul>\n<li>Una mejora voluntaria es un concepto de la misma naturaleza que el salario base fijado en su convenio. Es decir, se trata de un concepto que retribuye el tiempo de trabajo (la presencia del trabajador en la empresa).<\/li>\n<\/ul>\n<ul>\n<li>Actuando de este modo, cuando en el futuro se incremente el salario base del convenio, la empresa podr\u00e1 compensar y absorber esas subidas reduciendo la mejora voluntaria, a no ser que su convenio colectivo proh\u00edba la compensaci\u00f3n y absorci\u00f3n de salarios.<\/li>\n<\/ul>\n<p>Otra opci\u00f3n es distribuir en otros conceptos dicho exceso de salario respecto al m\u00ednimo fijado en el convenio; por ejemplo, para retribuir un pacto de plena dedicaci\u00f3n (exclusividad) o un pacto de no competencia poscontractual.<\/p>\n<p>\u00a0<\/p>\n<p> Nuestros profesionales le informar\u00e1n sobre cualquier duda que tenga sobre el pago de salarios.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Los convenios colectivos fijan la retribuci&oacute;n m&iacute;nima que deben cobrar los trabajadores, ya sea en c&oacute;mputo diario, mensual o anual.
