Sin embargo, el cumplimiento de dichos requisitos legales no siempre es suficiente para evitar la nulidad.<\/p>\n<p>La nulidad del despido supone que la empresa debe readmitir al empleado y abonarle los salarios de tramitaci\u00f3n (es decir, los salarios dejados de percibir desde el despido hasta la fecha de la sentencia que declara la nulidad).<\/p>\n<p>Algunas causas de nulidad est\u00e1n legalmente tasadas (embarazo, nacimiento de hijo, reducci\u00f3n o adaptaci\u00f3n de jornada por guarda legal&#8230;). Tambi\u00e9n es causa de nulidad la vulneraci\u00f3n de derechos fundamentales (siempre que quede acreditado que ha habido discriminaci\u00f3n). En este caso, adem\u00e1s de reincorporar al afectado y abonarle los salarios de tramitaci\u00f3n, la empresa tambi\u00e9n deber\u00e1 pagarle una indemnizaci\u00f3n por da\u00f1os morales.<\/p>\n<p>Si una empresa se encuentra en uno de los casos anteriores y no puede acreditar que existe una causa real y distinta que justifique la procedencia del despido, se declarar\u00e1 su nulidad.<\/p>\n<p>Aunque la empresa siga los requisitos de forma y causa exigidos para el despido, puede que entre el momento en que \u00e9ste se decide y el momento en que se realiza el trabajador sospeche y, para blindarse y provocar su nulidad, reclame alg\u00fan derecho laboral (solicite una adaptaci\u00f3n o reducci\u00f3n de jornada, presente un preaviso de elecciones sindicales postul\u00e1ndose como candidato&#8230;).
