Demandaron a la mercantil alegando <b>abusividad<\/b> y <b>falta de determinaci\u00f3n <\/b>en los contratos conforme a la Ley espa\u00f1ola y reclamando su nulidad y la devoluci\u00f3n del dinero pagado. La demandada argument\u00f3 que los tribunales espa\u00f1oles <b>no ten\u00edan competencia<\/b> y que la Ley aplicable era la inglesa, bas\u00e1ndose en cl\u00e1usulas contractuales y en las regulaciones de la UE y el Reino Unido.<b> <\/b>\u00a0<\/a><\/p>\n<p>El Supremo, invocando la jurisprudencia del TJUE, estima el recurso y establece que la ley aplicable es la inglesa, ya que coincide con la <b>residencia habitual<\/b> de los consumidores y la empresa dirige sus actividades a dicho Estado, independientemente de sus sucursales en Espa\u00f1a. Adem\u00e1s, el Rgto CE\/593\/2008 especifica que la ley aplicable es la del pa\u00eds en que <b>el consumidor tenga su residencia habitual<\/b> y esto es v\u00e1lido tambi\u00e9n para los contratos de aprovechamiento por turno de bienes inmuebles.<\/p>\n<p>Aunque la cl\u00e1usula de sumisi\u00f3n al Derecho ingl\u00e9s sea una <b>condici\u00f3n general no negociada<\/b>, es v\u00e1lida porque no priva a los consumidores de la protecci\u00f3n de las normas imperativas del Estado de su residencia habitual.
