{"id":5588,"date":"2025-01-07T00:00:00","date_gmt":"2025-01-07T00:00:00","guid":{"rendered":"https:\/\/www.contem.es\/retracto-arrendaticio\/"},"modified":"2025-01-07T00:00:00","modified_gmt":"2025-01-07T00:00:00","slug":"retracto-arrendaticio","status":"publish","type":"post","link":"https:\/\/www.contem.es\/es\/retracto-arrendaticio\/","title":{"rendered":"Retracto arrendaticio"},"content":{"rendered":"<p>Los demandantes suscribieron con una empresa municipal <b>contratos de arrendamiento<\/b> sobre 4 viviendas en un edificio de <b>protecci\u00f3n p\u00fablica<\/b>. Posteriormente, la arrendadora vendi\u00f3 a una mercantil, viviendas, plazas de garaje y trasteros, pertenecientes a varias promociones construidas bajo distintos reg\u00edmenes de protecci\u00f3n p\u00fablica, entre las cuales se encontraban las viviendas arrendadas a los actores. Los arrendatarios formularon demanda ejercitando acci\u00f3n de retracto arrendaticio respecto de cada uno de los pisos de los que eran inquilinos.<\/p>\n<p>El tribunal estima la pretensi\u00f3n de los arrendatarios. La <b>venta conjunta<\/b> de las viviendas o locales propiedad del arrendador que formen parte de un mismo inmueble, <b>excluye los derechos de tanteo o retracto<\/b> (LAU art.25.7), pero no puede suponer una <b>simulaci\u00f3n <\/b>para la elusi\u00f3n de tales derechos, por lo que debe constatarse que el objeto de la venta comprenda todas las fincas o unidades inmobiliarias que forman parte del edificio, \u00fanico supuesto en el que proceder\u00eda la exclusi\u00f3n.<\/p>\n<p>En este caso, la parte demandada <b>no ha acreditado<\/b> que la compraventa comprendiera todas las unidades del edificio, aparte de que en la escritura no consta que se transmitieran todas las viviendas, se dice expresamente que no fueron objeto de la transmisi\u00f3n 44 plazas de garaje del inmueble. De tal manera que no concurre el <b>presupuesto de hecho<\/b> para la denegaci\u00f3n del retracto, porque cuando no se transmiten todas las fincas del mismo edificio no puede pretenderse la aplicaci\u00f3n de las restricciones o limitaciones de la LAU art.25.7.<\/p>\n<p>Al no operar esta excepci\u00f3n, <b>s\u00ed se dan las condiciones<\/b> para el ejercicio del retracto, puesto que los pisos de los demandantes s\u00ed que constituyen <b>unidades f\u00edsicas y habitacionales independiente<\/b>.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p> En situaciones de controversia relacionadas con el alquiler de una vivienda, nuestros profesionales pueden asesorarle en la defensa de sus derechos<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Los demandantes suscribieron con una empresa municipal contratos de arrendamiento sobre 4 viviendas en un edificio de protecci&oacute;n p&uacute;blica.
