Se plantea si la acci\u00f3n hab\u00eda caducado en el momento en el que se ejercita.<\/p>\n<p>La Ley fija el <b>asiento de inscripci\u00f3n<\/b> de la compraventa en el Registro de la Propiedad como <b>fecha de referencia<\/b> para el c\u00f3mputo del plazo de caducidad del retracto, por constituir un medio seguro para:<\/p>\n<p>&#8211; que el colindante tenga un <b>conocimiento<\/b> cabal del negocio;<\/p>\n<p>&#8211; establecer una <b>fecha cierta<\/b>, para evitar la inseguridad en el tr\u00e1fico jur\u00eddico.<\/p>\n<p>Solo <b>a falta de inscripci\u00f3n<\/b>, se aplica la fecha de conocimiento de la venta. Este conocimiento <b>debe ser probado<\/b> por quien lo invoque, esto es, el adquirente, que quiera evitar que prospere la acci\u00f3n de retracto ejercitada contra \u00e9l.<\/p>\n<p>El que retrae ha de tener <b>conocimiento<\/b>, no s\u00f3lo del hecho de que se haya producido la venta, sino tambi\u00e9n del precio y de las dem\u00e1s circunstancias de la adquisici\u00f3n, porque solo as\u00ed puede <b>valorar convenientemente<\/b> si le interesa o no subrogarse en el lugar del comprador.
