Cl\u00e1usula abusiva de gastos"},"content":{"rendered":"<p>Un <b>consumidor<\/b> reclam\u00f3 judicialmente la nulidad de una de las cl\u00e1usulas del pr\u00e9stamo hipotecario que hab\u00eda firmado con una entidad bancaria por abusiva.<\/p>\n<p>Dicha <b>cl\u00e1usula <\/b>establec\u00eda a su cargo el pago de todos los gastos generados por el contrato de pr\u00e9stamo. Asimismo, reclamaba la <b>devoluci\u00f3n de las cantidades<\/b> que hab\u00eda abonado indebidamente (gastos de notar\u00eda, registro y gestor\u00eda, m\u00e1s sus intereses legales desde la fecha en que hizo estos pagos).<\/p>\n<p>El <b>juez<\/b> le dio la raz\u00f3n, pero la entidad bancaria recurri\u00f3 ante la <b>Audiencia Provincial<\/b> y esta declar\u00f3 que, aunque la cl\u00e1usula era abusiva, la acci\u00f3n de reclamaci\u00f3n de las cantidades abonadas por estos gastos hab\u00eda <b>prescrito<\/b>.<\/p>\n<p>La cuesti\u00f3n determinante es cu\u00e1ndo <b>comienza a correr el plazo<\/b> para reclamar esas cantidades. El consumidor recurri\u00f3 al Tribunal Supremo (TS) entendiendo que dicha acci\u00f3n no estaba caducada porque el plazo empieza a correr el <b>d\u00eda en el que se declara nula<\/b> la cl\u00e1usula, pues antes no se puede reclamar, mientras que la Audiencia Provincial hab\u00eda entendido que el plazo empieza a correr el <b>d\u00eda que se efect\u00faa el pago<\/b>.<\/p>\n<p>El TS plante\u00f3 cuesti\u00f3n prejudicial a los <b>tribunales europeos <\/b>que respondieron que este plazo empieza a correr cuando es<b> <\/b>firme<b> <\/b>la sentencia que declara\u00a0la nulidad de la cl\u00e1usula, puesto que ese es el momento en el que el consumidor puede <b>tener conocimiento de la irregularidad<\/b> de la misma. No obstante, la entidad bancaria siempre puede probar que el consumidor pudo tener con anterioridad a este momento conocimiento de dicho car\u00e1cter abusivo y con ello fijar el inicio del c\u00f3mputo en un momento distinto.<\/p>\n<p>En consecuencia, en aplicaci\u00f3n de esta doctrina el <b>TS<\/b>\u00a0acaba de estimar el recurso del consumidor, se\u00f1alando que, <b>salvo aquellos casos<\/b> en los que la entidad pruebe que ese consumidor en concreto pudo conocer que la cl\u00e1usula de gastos era abusiva en una fecha anterior, el <b>d\u00eda inicial del plazo<\/b> de prescripci\u00f3n de la acci\u00f3n de restituci\u00f3n de gastos hipotecarios indebidamente pagados por un consumidor es el de la firmeza de la sentencia que declara la nulidad de la cl\u00e1usula que obligaba a tales pagos.<\/p>\n<p> Nuestros profesionales est\u00e1n a su disposici\u00f3n para resolver cualquier tipo de duda que tenga respecto a su contrato de pr\u00e9stamo y ejercer si fuera preciso las acciones que puedan corresponder en la defensa de sus derechos <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Un consumidor reclam&oacute; judicialmente la nulidad de una de las cl&aacute;usulas del pr&eacute;stamo hipotecario que hab&iacute;a firmado con una entidad bancaria por abusiva.
