Por tanto:<\/p>\n<ul>\n<li>No es necesario que sea una declaraci\u00f3n de voluntad formal; basta que la conducta del empleado manifieste de modo indiscutible su opci\u00f3n por la ruptura o extinci\u00f3n de la relaci\u00f3n laboral.<\/li>\n<\/ul>\n<ul>\n<li>Dicha conducta debe ser clara, concreta, consciente y firme y evidenciar el prop\u00f3sito de dar por terminado el contrato.<\/li>\n<\/ul>\n<ul>\n<li>Las ausencias deben equivaler a un comportamiento que denote de manera clara que la persona desea extinguir la relaci\u00f3n laboral.<\/li>\n<\/ul>\n<p>Por ejemplo, un empleado no asisti\u00f3 al trabajo durante varios d\u00edas seguidos, la empresa le requiri\u00f3 explicaciones y no respondi\u00f3 ni contact\u00f3 con ning\u00fan compa\u00f1ero o superior, tras lo cual se descubri\u00f3 que ya estaba prestando servicios para otra empresa. En este caso se apreciaba claramente que ten\u00eda la intenci\u00f3n directa de abandonar el trabajo por su propia voluntad; por este motivo, se considerar\u00eda que ha habido una dimisi\u00f3n voluntaria.<\/p>\n<p>No obstante, si la empresa no ve claro que el comportamiento de su empleado refleje una voluntad clara y expresa de no volver a trabajar en su empresa, debe hacer lo siguiente:<\/p>\n<ul>\n<li>Pedir explicaciones sobre las ausencias a trav\u00e9s de su correo electr\u00f3nico o tel\u00e9fono m\u00f3vil, o incluso mediante burofax.<\/li>\n<\/ul>\n<ul>\n<li>Si el trabajador no ofrece explicaci\u00f3n o justificaci\u00f3n, esperar los d\u00edas que requiera el convenio colectivo y realizar un despido disciplinario por ausencias injustificadas.<\/li>\n<\/ul>\n<ul>\n<li>\u00danicamente en el caso de que el empleado exprese la voluntad de no seguir en la empresa o cuando la empresa se entere de que presta servicios en otro lugar, podr\u00e1 entenderse que se ha producido una dimisi\u00f3n.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p> Nuestros profesionales le resolver\u00e1n cualquier duda relacionada con la Inspecci\u00f3n de Trabajo y la tramitaci\u00f3n de denuncias.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Existe dimisi&oacute;n cuando hay una voluntad unilateral del trabajador de renunciar al puesto de trabajo, sea de forma directa (mediante signos escritos u orales dirigidos al empresario) o t&aacute;cita (mediante un comportamiento del cual cabe deducir esa intenci&oacute;n extintiva).
